Musk’s Data Center Accused Of Bypassing Clean Air Regulations

MEMPHIS, TN- Elon Musk’s AI company, xAI, is under renewed scrutiny after a Reuters investigation reported that 59 portable natural gas turbines have been installed to power its Colossus 2 data center, with the units allegedly operating without permits required under the Clean Air Act.

The report estimates that 30 of those turbines alone could release about 2,500 tons of nitrogen oxides, 4,000 tons of carbon monoxide and 22 tons of formaldehyde each year. Reuters said the projected nitrogen oxide emissions far exceed the Clean Air Act’s 100-ton annual threshold that generally triggers permitting requirements for turbines.

The issue has also become the focus of a lawsuit filed by the NAACP. The organization alleges the unpermitted turbines have resulted in a 111 percent increase in nitrogen oxide emissions, an 83 percent rise in PM2.5 particulate pollution and an 88 percent increase in formaldehyde emissions.

Reuters reported that neighborhoods closest to the facility are predominantly Black communities that already experience disproportionately high rates of lung disease. Because the data center sits near the Tennessee-Mississippi border, the report cited census figures from neighboring counties to show the demographics of the surrounding population.

xAI has maintained that 27 of the turbines it is operating do not require permits because they are temporary units that will be relocated within 364 days. Reuters, however, reported that 59 portable turbines have been deployed at the site. Earlier this year, the Environmental Protection Agency removed exemptions for portable turbines but told Reuters it is considering regulatory changes that would allow flexibility for such equipment while continuing to protect public health.

According to Reuters, the company relied on on-site natural gas turbines because connecting the facility to the electrical grid could take years, particularly if upgrades are needed to support its planned power demand. The report added that Mississippi approved permits in March for 41 permanent turbines, but those permits do not apply to the portable units. It also said at least 57 of the 59 turbines are located across the state line in Mississippi, even though they serve the Tennessee data center.

Questions about the project predate the Reuters investigation. The report noted that local residents had previously identified more than 30 turbines operating at the site while the company had only a pending permit application for 15 turbines in July 2025.

Amid the dispute, SpaceXAI, formed after the merger of xAI and SpaceX, recently announced a 50 percent discount and free Starlink hardware rentals for people living near the Colossus facilities. The company said the offer recognizes the support of the local community, while critics quoted by Reuters argued it does not address concerns over air and noise pollution.
