SACRAMENTO, CA- A coalition of 17 attorneys general and the State of Pennsylvania filed a lawsuit against the Trump Administration, alleging the unlawful suspension of federal funding for electric vehicle (EV) charging infrastructure approved by Congress.

The lawsuit challenges the U.S. Department of Transportation’s refusal to approve new funding under two bipartisan grant programs created by the Infrastructure Investment and Jobs Act: the Charging and Fueling Infrastructure Program and the Electric Vehicle Charger Reliability and Accessibility Accelerator Program, which support the expansion, repair, and maintenance of EV charging networks nationwide.

California Attorney General Bonta said, “The Trump Administration’s illegal attempt to stop funding for electric vehicle infrastructure must come to an end,” warning the move threatens efforts to curb pollution, spur innovation, and create jobs.

California Governor Gavin Newsom said the state would not accept the withholding of funds approved under the Bipartisan Infrastructure Law. “California will defend the Constitution, our communities, and the future we’re building,” Newsom said, noting the state has 2.4 million zero-emission vehicles on its roads and multiple EV projects ready to proceed.

According to the complaint, USDOT and the Federal Highway Administration have refused all new funding obligations under the programs since spring 2025. The CFI program provides $2.5 billion nationally for EV charging and hydrogen fueling infrastructure, while the Accelerator program supports charger repair and reliability.

Officials have said the funding pause has stalled key projects, placing $179.8 million in federal awards at risk, including freight corridor charging, port-area electrification, and repairs of non-operational chargers.

The coalition is asking the court to declare the suspension unlawful and permanently block the administration from withholding congressionally approved funds.
