Trump’s EPA Proposes AI Data Centers Face Less Scrutiny Over Pollution

WASHINGTON, DC – The Environmental Protection Agency under President Donald Trump has proposed giving states and some local authorities greater discretion over whether the public is notified about pollution from proposed data centers and other facilities classified as “minor” pollution sources.
Trump is a known supporter of establishing data centers who does not believe the environmental costs outweigh AI development, even though several states, including the one he looks on favorably, Texas, have instituted varying levels of regulation.
The EPA said the change is intended to make the permitting process faster and reduce administrative requirements. The agency said the proposal would “reduce administrative burden and responsibly speed up permitting, supporting American economic development and energy dominance” while putting state agencies “most familiar with local issues in the driver’s seat”.
The agency also told The Guardian that the proposal “does not alter emission standards or weaken environmental protections”.
Under the current system, the Clean Air Act requires “minor” air pollution sources to disclose through state agencies how much pollution a proposed project is expected to release. The proposed rule would make that disclosure voluntary, depending on state and, in some cases, local officials.
The EPA delegates oversight of minor pollution sources to state authorities, while major polluters such as gas plants are handled by the federal agency. The minor designation applies to projects proposing enough pollution controls to avoid emissions levels requiring immediate federal oversight.
The permits are intended to ensure facilities comply with federal limits covering six pollutants associated with asthma, heart disease and cancer.
The issue has become particularly relevant as data center construction grows alongside the expansion of artificial intelligence. Developers can seek minor-source permits for the dozens of diesel generators or gas turbines used to power facilities or provide backup generation.
According to the original report, large technology companies sometimes divide permit applications among individual generators or turbines so that they are considered through minor-source reviews conducted by states rather than a larger EPA review.

The Trump administration is also seeking to accelerate data center development by expanding opportunities for “islanded” power-generation facilities. These facilities generate their own power rather than connecting to the grid, where their pollution is more closely scrutinized.
The EPA has closed the public comment period on the proposed rule. If finalized, the rule could face a legal challenge.
