SAN FRANCISCO, CA – Billionaire venture capitalist Vinod Khosla’s lengthy legal battle to restrict public access to a beloved surfing spot near San Francisco encountered another setback. A California state judge, in a recent tentative ruling, dismissed Khosla’s bid to dismiss a lawsuit brought by a state agency. The agency argues that Khosla lacks the authority to block public entry to Martins Beach, a picturesque coastline area.

Khosla’s acquisition of the property in 2008 for $32.5 million led to the installation of a gate, effectively closing off access to the cove. His legal team contends that as the property owner, Khosla had the right to control access unless adequate compensation was offered.

Despite Khosla’s persistent legal efforts, including an unsuccessful appeal to the US Supreme Court in 2018, the tide seems to be turning against him. Superior Court Judge Raymond Swope’s tentative ruling sided with state officials, acknowledging their arguments for public access rights based on historical use and California law.

The State Lands Commission is seeking a court order to prevent Khosla from obstructing the road to Martins Beach, citing established access rights. Khosla retains the option to appeal the ruling or request a reconsideration by the judge.
