USCIS Reaches Fiscal Year 2025 H-1B Visa Cap

WASHINGTON, DC – The U.S. Citizenship and Immigration Services (USCIS) has reached the congressionally mandated cap for H-1B visas for fiscal year 2025. The agency announced on December 2, 2024, that it has received enough petitions to fill both the regular cap of 65,000 visas and the advanced degree exemption (commonly called the master’s cap) of 20,000 visas.
Next Steps for Registrants
Over the coming days, USCIS will notify registrants whose applications were not selected via their online accounts. For unselected applications, the status will update to:
“Not Selected: Not eligible to file an H-1B cap petition based on this registration.”
Exemptions and Ongoing Processing
USCIS clarified that it will continue to accept and process petitions exempt from the cap. These include petitions for:
- Current H-1B workers already counted against the cap who retain their cap number.
- Extensions of H-1B status for workers already in the U.S.
- Changes in terms of employment for existing H-1B workers.
- Transfers of H-1B workers to new employers.
- Authorization for H-1B workers to take on additional roles.
